However, installers cannot simply focus on the quality, coverage or system performance of their cameras, as they also need to understand privacy laws and any regulations regarding data protection.
Any mistakes can lead to complaints as well as investigations from the ICO, disputes with neighbours and significant reputational damage, so we have put together a practical guide for installers to help ensure their systems and customers are always compliant.
Many homeowners assume that they can place cameras anywhere on their property, but the legal situation changes if cameras capture public spaces, footpaths, roads, shared driveways or neighbouring property. Once the CCTV records beyond the boundary of the property, then UK GDPR and Data Protection Act obligations may apply.
Domestic CCTV used purely within property boundaries is generally exempt from data protection law, but if cameras capture external areas, the homeowner will become responsible for handling personal data lawfully. Installers are often blamed for cameras being positioned incorrectly, systems recording too broadly or audio recording that can lead to complaints.
Professional installers therefore need a working understanding of CCTV law before the installation process begins.
It is important that installers understand the rules regarding recording beyond property boundaries. All cameras should avoid any unnecessary coverage of neighbours gardens, windows, public footpaths and roads.
They should only record what is genuinely needed for security, and any overly intrusive positioning can trigger privacy complaints, ICO concerns and neighbour disputes. This means installers should make sure they adjust angles, zoom settings, and motion detection zones accordingly.
There are also several GDPR and data protection considerations for installers. If CCTV catches people outside the property boundary, then recorded footage becomes personal data. This creates responsibilities around lawful use, secure storage, controlled access and retention periods.
Homeowners may therefore need to respond to subject access requests and explain why the CCTV is being used and are responsible for ensuring that the footage is not misused. If installers understand these obligations, they can configure systems appropriately and provide the correct advice for customers.
Some CCTV systems have audio recording capabilities which can be considered more intrusive than video surveillance. Many domestic systems include microphones by default, and continuous audio capture can be extremely difficult to justify in most domestic settings. Installers should therefore consider disabling audio recording unless there is a clear and legitimate reason to use it.
What happens to the footage that has been recorded is also very important as it should not be retained indefinitely without reason. The retention periods for the footage should be reasonable, and systems should automatically overwrite old footage where appropriate.
The storage of footage must be secure to ensure it cannot be stolen, accessed by unauthorised users or tampered with, including the use of strong passwords, secure apps, and encrypted remote access wherever possible.
Whilst installers may not be the legal data controller, they can still face complaints, reputational damage and customer disputes. Customers expect professional installers to understand the compliance risks of CCTV systems and advise them accordingly.
Installers need to make sure they protect their professional reputation as trust is critical within the CCTV industry. Poorly planned installations can generate negative reviews, and neighbour complaints can damage your reputation in the local area. Strong compliance knowledge will help to position installers as professionals rather than basic equipment fitters.
Installers need to think carefully about how they position cameras so that they focus on the customer’s property and minimise any unnecessary recording. They should avoid direct views into neighbouring windows or gardens and use privacy masking where available. It is also important to avoid excessive street coverage unless this is necessary. Most modern CCTV systems often include privacy zones, motion detection controls and adjustable fields of view which can be used as best practice.
A domestic CCTV installation may also have signage requirements if it records public areas or spaces beyond the property boundary. These signs should inform people that CCTV is in operation and explain who operates the system. Where appropriate, this signage can be significant in helping to demonstrate transparency and reducing complaints.
It is also important that installers are aware of secure access control. Only authorised people should be able to access CCTV footage, so there needs to be strong passwords in place and restricted app access. There should also be multi-user permissions where applicable and default passwords need to be changed during the installation process to ensure they are secure.
Installers should make sure that homeowners understand their own CCTV responsibilities. It is the homeowner who is normally responsible for complying with data protection law, so you should explain good practice, configure the systems responsibly and warn against intrusive positioning.
Installers must avoid giving formal legal advice or making guarantees about compliance. It is therefore better to provide practical guidance, recommend proportionate camera use and encourage customers to review the ICO guidance themselves where necessary.
Installers should explain that cameras can legally capture limited external areas if it is justified for security purposes. However, excessive or intrusive monitoring may create privacy concerns.
Homeowners should be informed that if their cameras only record within property boundaries, signage may not legally be required, but it should be strongly recommended if public areas are being recorded.
Installers need to explain that this will depend on camera positioning, what is being recorded and whether recording is proportionate. Any persistent or excessive monitoring may lead to complaints or involvement from the ICO.
